1. Acceptance of Terms

By purchasing, possessing, or using any product sold under the NYNESENSE name (“NYNESENSE,” “we,” “us,” or “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in full. These terms apply to all sales, all products, and all uses without exception.

2. Product Nature & Intended Use

NYNESENSE fragrances are luxury artisanal fragrance products intended solely for external use. Products are not intended for ingestion, inhalation, or internal application.

Products are not medical, cosmetic, or therapeutic treatments. No claims are made regarding health, wellness, mood alteration, or psychological effects.

NYNESENSE fragrances are formulated at Extrait and Ultra-Extrait concentrations, which exceed standard industry oil concentration averages and are designed for measured, intentional application.

3. Assumption of Risk & Skin Sensitivity

By purchasing or using NYNESENSE products, you voluntarily assume all risks associated with fragrance use, including but not limited to:

Skin sensitivity or irritation

Allergic reactions (known or unknown)

Olfactory fatigue or discomfort

Reactions due to over-application or misuse

Individual reactions vary. NYNESENSE makes no representation or guarantee of suitability for any individual user.

A patch test is strongly recommended prior to full application.

NYNESENSE assumes no responsibility for reactions, sensitivities, or adverse effects, whether foreseeable or unforeseeable.

4. Limitation of Liability

To the maximum extent permitted by law, NYNESENSE shall not be liable for:

Indirect, incidental, special, or consequential damages

Personal discomfort, dissatisfaction, or subjective perception

Reactions arising from use, misuse, or individual sensitivity

In all circumstances, NYNESENSE’s total liability is strictly limited to the original purchase price of the product.

5. Refunds, Returns & Order Finality

Due to the consumable, hygienic, and artisanal nature of fragrance products:

All sales are final. Returns, exchanges, or refunds are not offered for preference, perception, intensity, longevity, or dissatisfaction. Refunds are considered only if a written cancellation request is received before order processing begins. Once an order has entered processing or shipment, it is final and non-refundable.

6. Shipping, Delivery & Risk Transfer

NYNESENSE ships orders using third-party carriers. Title and risk of loss transfer to the customer upon delivery of the shipment to the carrier. NYNESENSE is not responsible for carrier delays, damage, loss, or theft after transfer. Shipping timelines are estimates and not guarantees.

7. Proper Use & Misuse Disclaimer

Products must be used in accordance with provided safety and application guidelines.

Misuse, including improper storage or application, voids any liability on the part of NYNESENSE.

8. No Medical or Therapeutic Claims

NYNESENSE products are not intended to diagnose, treat, cure, or prevent any medical condition. All scent descriptions are artistic and sensory interpretations only and do not constitute medical or psychological claims.

9. Intellectual Property

All NYNESENSE names, fragrances, formulas, designs, packaging, imagery, text, and branding elements are the exclusive intellectual property of NYNESENSE.

Unauthorized reproduction, imitation, distribution, or derivative use is strictly prohibited.

10. Modifications to Terms

NYNESENSE reserves the right to modify these Terms of Service at any time without prior notice. Continued use of products or services constitutes acceptance of any revised terms.

11. Governing Law

These Terms of Service shall be governed by and interpreted under the laws of the State of [YOUR STATE], without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the appropriate courts of this jurisdiction.
